AXUS warrants to the original purchaser that all the hardware product shall be free from defects in material and workmanship from the date of purchase to the corresponding standard warranty period. AXUS, at its expense and option, shall either repair or replace any products or parts thereof which is proven defective under the warranty period. Replacement, if required, shall be with new, comparable, or reconditioned products and subject to the following:
01. This limited warranty policy covers labor and parts under warranty period, but requests for returning of the defect products will not be honored by AXUS until customer completes and submits the RMA Report from AXUS website (www.axus.com.tw) and received the assigned RMA number from AXUS for each product claimed.
02. This limited warranty does not cover losses or damages that occur as a result of shipping; improper installation or maintenance, misuse or accident.
03. Customer shall return the product, freight prepaid and insured (or assume the risk of loss or damage during shipment) in the original container or an equivalent to AXUS with registered RMA No. AXUS shall ship repaired/replacement products freight prepaid to the customer. If the customer has a pending delivery, the repaired/replacement products shall be shipped together with the customer's other order. Otherwise, it will be shipped separately. Both parties agree to use the same means of shipping.
04. Products returned to AXUS for service, in warranty and post warranty, which are diagnosed as no fault found will be subject to a diagnostic fee.
05. In case that services required by customer are out of warranty or the responsibility of the failures are not ascribable to AXUS, the customer will be the one who shall bear shipping cost on delivery both way.
06. AXUS' liability for the losses and damages shall not exceed the price of the individual unit whose defect or damage is the basis for the claim.
07. Claimable shall be returned within 14 working days after the receipt from customer.

WARRANTY PERIOD for YOTTA Series Hardware --- Effective from January 01, 2008
Subsystem including RAID controllers, Daughter board and Back-plane: 3 years
Power supplies: 2 years
Battery module, LCD module and other Optional Spare Parts: 1 year
Accessories and mechanical parts without warranty except missing, wrong parts or DOA.
WARRANTY PERIOD for FiT Series Hardware --- Effective from May 01, 2009
FiT Series RAID Products: 2 years
Power supplies, Power Adapter, LCD module and other Optional Spare Parts: 1 year

Dead On Arrival (DOA) systems are those units that have failed upon arrival at the customer's location. For the disposition on DOA units, it's customer's responsibility to submit the DOA claim within 7days of receipt and to ship out these units to AXUS within 14days. AXUS shall complete the replacement shipment within 14days from the date of customer's claim. AXUS shall arrange and pay the insurance and freight for both returning and replacing the products.
 
     
   
     
 
Out of Warranty refers to those products that are no longer covered by the "Regular Warranty". AXUS will repair or replace the defective products within 27 working days from receipt, provided, however, that any such repair or replacement is contingent upon the availability of the required components. The customer shall pay the two-way shipping, packing, insurance, and other costs, including necessary labor and parts. Customer shall ship defective products freight prepaid to AXUS. AXUS shall ship repaired products freight collect to the customer. If the customer has a pending delivery, the repaired products shall be shipped together with the customer's order. Otherwise, it will be shipped separately. All out-of-warranty products serviced for a fee (please inquire) will have 90 days of extended warranty. The 90 days warranty shall begin on the date the repaired product shipped from AXUS.
01. End user reports the defect to buyer.
02. After identify the problem, Buyer should fill in a RMA form and send to Axus to ask RMA No.
03. According to the RMA form, Axus can distinguish the defective goods is under Warranty or not. if the defective goods is under warranty, Axus will issue RMA No. to customer immediately.
04. If the defective goods is over warranty Axus will inform the status to Buyer.
05. All shipment of defective goods have to send back with the RMA No. the shipment of replacement or repaired goods will be done by same way.
06. Axus will offer the defective report to Buyer after engineer repaired the defective goods.

AXUS HEREBY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OR WARRANTIES OTHERWISE ARISING BY OPERATION OF LAW, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCT AND ANY OTHER MATERIALS AND SERVICES, AND WITH RESPECT TO THE USE OF ANY OF THE FOREGOING.

THE REMEDIES STATED IN THIS DOCUMENT CONSTITUTE THE CUSTOMER'S EXCLUSIVE REMEDIES AND AXUS'S SOLE LIABILITY FOR BREACH OF THE LIMITED WARRANTIES SET FORTH HEREIN.

 
     
   
     
 
IN NO EVENT SHALL AXUS'S TOTAL, CUMULATIVE LIABILITY ARISING FROM THE SALE, USE AND DISPOSITION OF THE PRODUCT EXCEED THE AMOUNT OF ACTUAL DIRECT DAMAGES, UP TO THE CHARGES FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM

IN NO EVENT SHALL AXUS BE LIABLE TO CUSTOMER OR ANY THE OTHER FOR ANY PUNITIVE, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES, INCLUDING LOSS OF PROFITS, INCURRED BY THAT PARTY, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OR PRODUCT LIABILITY) OR WARRANTY, IN CONNECTION WITH THE SALE, USE AND DISPOSITION OF THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
